A court case instituted against a catholic mission school,St Kizito Secondary School,Umudioka by the Anambra State Signage and Advertising Agency (ANSAA)over non payment of signage and advertising fee,has been struck out by a Chief Magistrate Court in Awka,Anambra State on Tuesday.
Information reaching Trinitas News Desk said the matter was thrown out following intervention of counsel to the Archdiocese of Onitsha,Barrister Sir Azubike Anazor who resisted the prosecution following preliminary objections he raised on the matter. Barr Sir Anazor who was asked by Rev Fr Damian Ojukwu,Manager of the School, to defend the school,raised preliminary objection to further trial of the defendants(the School Management), arguing that on a strict interpretation of the relevant provisions of the Anambra State Signate and Advertisement Agency Law 2010, St Kizito Secondary School,Umudioka does not come within the category of institutions and businesses contemplated by the enabling law.
Following Sir Anazor’s reply,the government lawyer and the prosecuting government agency were dumb founded and had no answer to this submission and could not pushback against the legal points raised in the preliminary objection.
Accordingly, the charge was struck out and the criminal proceedings against the school terminated.
