By Ononye VC An Onitsha High Court on Friday refused the application by the Ukwa family of Umuasele Village Onitsha to join as Defendants in the case brought by a Pentecostal Group against the Anambra State Government and the Catholic Archdiocese of Onitsha over ownership of Ugborimili Schools, Fegge Onitsha.
The Motion for Joinder was opposed by the defendants – the Anambra State Government and the Catholic Archdiocese of Onitsha.
In his objection to the Motion, Sir Azubike Anazor, Senior Counsel for the Catholic Archdiocese of Onitsha, had argued that the coming in of the Ukwa family was not necessary for the effectual and complete determination of the issues in contention between the original plaintiffs and the defendants.
The issue before the court, according to Barr Anazor,was a straight forward one of the rightness or otherwise of the return of Ugborimili Schools to the Catholic Church by the Anambra State Government.
“The Ukwa family of Umuasele Village Onitsha had nothing to do with such determination”, he had argued. The court agreed with this reasoning, amongst others, and refused the application for joinder.
It therefore adjourned the case to 25th March,2025 for hearing of the substantive suit.
S. C Udo Esq represented the Ukwa family, Onitsha. Ifeanyi Agwuncha, Principal State Counsel, appeared for the State Government, while Sir Azubike Anazor defended the Catholic Archdiocese of Onitsha.
